2. What is Personal Data?

Personal data means any information capable of identifying and individual. It does not include anonymised data.

We may also process Aggregated Data from your personal data but this data does not reveal your identity and as such in itself is not personal data. An example of this is where we review your Usage Data to work out the percentage of website users using a specific feature of our site.  If we link the Aggregated Data with your personal data so that you can be identified from it, then it is treated as personal data.

Where we are required to collect personal data by law, or under the terms of the contract between us and you do not provide us with the data when requested, we may not be able to perform the contract (for example to deliver goods or services to you). If you don’t provide us with the requested data, we may have to cancel a product or service you have ordered but if we do, we will notify you at the time.

We collect data about you through a variety of different methods including:

Technical Data from the following parties:  Dropbox, SoundCloud, Mailchimp, analytics providers such as Google based outside of the EU; Facebook based inside and outside the EU; and identify and contact data from publicly available sources such as Companies House and the Electoral Register based inside the EU.

Comments

When visitors leave comments on our site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comments.

Visitor comments may be checked through an automated spam detection service.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

5. How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

Identity, Contact and Sensitive Data which is shared with us as part of the coaching or hypnotherapy process is retained as per Section B of the IG Policy.

6. What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

7. Marketing Communications

You will receive marketing communications from us if you have:

  • Requested information form us or purchased goods or services from us;
  • Provided us with your details when you have entered a competition or registered for a promotion or free resource.

We will get your express opt-in consent before we share your personal data with any third party for marketing purposes.

You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you

Where you opt out of receiving our marketing communications, this will not apply to personal or sensitive data provided to us as a result of a product/service purchase, warranty registration, product/service experience or other transactions.

8. Change of purpose

We will only use your personal data for the purpose for which we collect it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for a purpose unrelated to the purpose for which we collected the data we will notify you and we will explain the legal ground of processing.

9. Disclosures of your Personal Data

We may have to share your personal data with parties set out below for the purposes set out in the table above.

  • Service providers who provide IT and system administration purposes
  • Professional advisers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services
  • HM Revenue and Customs, regulators and other authorities based in the UK and other relevant jurisdictions who require reporting of processing activities in certain circumstances

We require all third parties to whom we transfer your data to respect the security of your personal data and to trust it in accordance with the law. We only allow such third parties to process your personal data for specified purposes and in accordance with our instructions.

10. Internal Transfers

Countries outside of the European Economic Area (EEA) do not always offer the same levels of protection to your personal data, so European law has prohibited transfer of personal data outside the EEA unless the transfer meets certain criteria.

Many of our third party service providers are based outside the EEA so their processing of your personal data will involved a transfer of data outside the EEA.

Whenever we transfer your personal data out of the EEA, we do our best to ensure a similar degree of security of data by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission; or
  • Where we use certain service providers, we ay use specific contracts or codes of conduct or certification mechanisms approved by the European Commission which give personal data the same protection it has in Europe; or
  • Where we use providers based in the United States we may transfer data to them if they are part of the EU-US privacy shelf which requires them to provide similar protection to personal data shared between the EU and the US.

If none of the safeguards is available we may request your explicit consent to the specific transfer. You will have the right to withdraw this consent at any time. 11. Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition we list access to your personal data to those employees, agents, contractors and other third parties who have a business need to know such data. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspect data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Under certain circumstances you have rights under data protection laws in relation to your personal data.  These include the right to:

You will not hae to pay a fee to access your personal data. However  we ay charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively we ay refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request if particularly complex or you have made a number of requests. In this case we will notify you and eep you updated.

This website may include links to thrip-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you.
